Prevention and eco-design plan
According to Article L 541-10-12 of the AGEC law enacted in February 2020:
Every producer is required to develop and implement a prevention and eco-design plan with the objective of reducing the use of non-renewable resources, increasing the use of recycled materials, and increasing the recyclability of its products in processing facilities located on the national territory.
This plan must be reviewed every five years. It may be drawn up individually or jointly by several producers. It includes an assessment of the previous plan and sets out the prevention and eco-design objectives and actions to be implemented by the producer over the next five years.
Individual and joint plans must be submitted to the producer responsibility organisation set up by producers, which publishes a publicly accessible summary after presenting it to the representative body of the relevant sector’s stakeholders.

The essentials you need to know
The PPE (Prevention and Eco-design Plan) sets out actions and objectives aimed at reducing the use of non-renewable resources, encouraging the use of recycled materials and improving the recyclability of new products.
It must be reviewed at least every five years and include an assessment of the previous plan.
The confidentiality of all data contained in the PPE is guaranteed.
The plan can now be submitted directly online via the e-ecodesign tool.
New members have one year from their membership date to submit their PPE.
The plan must be submitted to Ecologic, which will publish a summary for public authorities and stakeholders and make it freely available to the general public.
Please note: In accordance with Article L.541-9-5 of the Environmental Code, companies placing products on the market that fail to comply with their legal obligations may be subject to administrative penalties.

Expected content of the plan
The plan must set out prevention and eco-design actions aimed at:
Reducing the use of non-renewable materials
Increasing the use of recycled materials
Improving product recyclability
It may also cover other relevant areas, such as impacts at every stage of the product life cycle (manufacturing, transport, use, etc.), as well as the processes, tools, training programmes or measures introduced to promote eco-design.
Advice and recommendations
Focus on realistic and concrete actions that your organisation will actually be able to implement.
Include an assessment of actions already carried out in order to demonstrate the progress made.
You do not need to complete every field: you simply need to include at least one action for each of the three main areas.
If you are a member of several producer responsibility organisations, draw up one plan for each sector and submit it to each organisation concerned. Some of the content may be identical across several EPR sectors.
